Medical Center – Core and Shell

VERTEX was retained by a surety and its legal counsel to review and respond to a $7.4M delay claim by a general contractor against its carpentry drywall subcontractor for the core-and-shell construction of a medical center in Brooklyn, New York. The Project is a seven-story medical office building, with two levels of associated parking facilities, diagnostic space, and physician offices.

VERTEX performed a forensic schedule analysis using the Windows Analysis methodology in accordance with AACE Recommended Practice 29R-03 to determine the activities and parties that impacted the performance period. VERTEX also supplemented its Windows Analysis with a Time-Impact Analysis for the purposes of illustrating the presence of concurrent delays over the alleged delay period. Following the issuance of VERTEX’s report, a settlement was achieved between the parties.
